Article 2 — Applicability

These terms and conditions apply to every offer by AFTERFADE BV and to every agreement concluded through the webshop www.afterfade.be. By placing an order, the customer confirms having read and fully accepted these terms. Deviations are only valid when expressly confirmed in writing by AFTERFADE BV.

Article 3 — Offer and product information

AFTERFADE BV takes the greatest care in publishing information about its products. All product descriptions, images, specifications and prices are presented as accurately as possible. Obvious errors, misprints or mistakes do not bind AFTERFADE BV. Images are for illustration only and may differ from the product actually delivered.

Article 4 — Prices

All prices are expressed in euro (€) and include VAT. Any shipping costs are shown separately during checkout before the order is finally confirmed. AFTERFADE BV reserves the right to adjust its prices at any time. The price applicable at the time of ordering remains valid for that order.

Article 5 — Orders and payment

An agreement is concluded once the customer places an order and AFTERFADE BV confirms it by email. AFTERFADE BV reserves the right to refuse orders or request additional information in case of suspected fraud, abuse or payment problems.

Payments are processed by secure external payment service providers. The customer may use the payment methods offered during checkout; AFTERFADE BV reserves the right to change or extend the range of payment methods. Orders are processed only after payment has been successfully received and approved.

Article 6 — Delivery

Delivery takes place at the address provided by the customer during checkout. AFTERFADE BV aims to dispatch orders within 3 working days of receiving payment. Delivery times are indicative and do not constitute an obligation of result; delays do not entitle the customer to compensation, except in cases of intent or gross negligence. The risk of loss or damage passes to the consumer as soon as the consumer, or a third party designated by the consumer, has physically taken possession of the goods.

Article 7 — Right of withdrawal

The consumer has the right to withdraw from the agreement within 14 calendar days without giving any reason. The withdrawal period expires 14 calendar days after the day the consumer, or a third party designated by the consumer, physically takes possession of the goods.

To exercise this right, the consumer must inform AFTERFADE BV by email or in writing. The goods must be returned no later than 14 calendar days after notifying us. Goods must be returned in their original condition and packaging, insofar as reasonably possible. The direct cost of returning the goods is borne by the consumer, unless agreed otherwise.

AFTERFADE BV will refund all payments received from the consumer, including standard delivery costs, within 14 calendar days of receiving the withdrawal notification. The refund may be withheld until the goods have been received or the consumer has proven that the goods were returned.

Article 8 — Exclusion of the right of withdrawal

In accordance with Article VI.53 of the Belgian Code of Economic Law, the right of withdrawal does not apply to:

  • goods manufactured to the consumer's specifications;
  • goods clearly intended for a specific person;
  • sealed goods that are not suitable for return for health or hygiene reasons and whose seal was broken after delivery;
  • goods that after delivery are irrevocably mixed with other products.

Article 9 — Legal warranty

All products carry the legal two-year warranty under Belgian consumer law. The consumer must report any defects to AFTERFADE BV within a reasonable period after discovery via info@afterfade.be. The warranty does not cover damage caused by normal wear, incorrect or improper use, negligent maintenance, accidents, or modifications made by the customer or third parties.

Article 10 — Safe use of the products

Afterfade products carry legally required hazard and safety information (CLP) on their labels and on the product pages of the webshop. Always read the label and product information before use, follow the application and safety instructions, and keep the products out of the reach of children. AFTERFADE BV is not liable for damage resulting from use contrary to the instructions.

Article 11 — Retention of title

All delivered goods remain the property of AFTERFADE BV until full payment of the order has been received.

Article 12 — Liability

AFTERFADE BV is only liable for direct damage resulting from a proven fault of AFTERFADE BV. AFTERFADE BV cannot be held liable for indirect damage, consequential damage, loss of profit or damage to third parties, except where this cannot legally be excluded. Nothing in these terms excludes liability for intent, gross negligence, death or personal injury insofar as the law prohibits such exclusion.

Article 13 — Force majeure

AFTERFADE BV is not liable for delays or shortcomings resulting from force majeure, including natural disasters, pandemics, strikes, transport problems, cyber-attacks, power failures, government measures, or failures at suppliers or logistics partners. During force majeure, the obligations of AFTERFADE BV are suspended for as long as the situation persists.

Article 14 — Complaints

Complaints can be submitted by email to info@afterfade.be. AFTERFADE BV endeavours to handle and answer every complaint within a reasonable period.

Article 15 — Online dispute resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. Consumers may use this platform to settle disputes out of court.

Article 16 — Applicable law and competent court

All agreements between AFTERFADE BV and the customer are governed exclusively by Belgian law. Disputes will be submitted to the competent courts in accordance with Belgian legal provisions.

Article 17 — Privacy

AFTERFADE BV processes personal data in accordance with its privacy policy and applicable privacy legislation, including the General Data Protection Regulation (GDPR).
